Scrap Metal Dealers Licence

Summary

In order to run a scrap metal business you must be licenced by the Council.  The two categories of licence are:

  • Site Licence - this may be for multiple sites within the Bath and North East Somerset area; and
  • Collector's Licence - a separate licence will be required from each Council in whose area you wish to collect.

  • £306 - Application fee to be charged at time of application
  • £334 - Maintenance fee to be charged prior to issue

Renewal

  • £306 - Application fee to be charged at time of application
  • £334 - Maintenance fee to be charged prior to issue

  • £27 - Change of details

You may pay in person or over the phone (01225 477531) using a credit or debit card.  Please note that although there will be no charge for debit cards, there will be an additional charge of 2.5 % for credit card payments.

Validity/Renewals

Unless otherwise stated, licences will be valid for three years.

Eligibility Criteria 

The Council can only issue a licence to someone they consider to be suitable.  Relevant offences and enforcement action may be taken into consideraiton, as well as any other information.  We need to ensure that a person or company applying for a licence exitis so you may be required to present your ID.

Application
Process

As part of the application process, the applicant must provide a DBS basic disclosure.  The Council will also consult with agencies such as the Police, British Transport Police, the Environment Agency and other departments within the Council.  All this information will be considered when deciding whether to grant the licence.

 

If the Council is minded to refuse a licence application, the applicant will be given the opportunity to make written or personal representations (by letter or in person).

 

Payment must be made at the same time as you submit your application.

 

We will consult other agencies about the applicant’s suitability to be licensed as a scrap metal dealer, as per section 3(7) of the Scrap Metal Dealers Act 2013.  Those other agencies will include other local authorities, the Environment Agency, the Natural Resources Body for Wales and the police.

 

The purpose of sharing this data is to form a full assessment of the applicant’s suitability to be licensed as a scrap metal dealer.  The sharing of information will include any personal data submitted in the application form such as any previous criminal offences.  Details will also be displayed on a national register, as required by the Scrap Metal Dealers Act 2013.

Conditions 

The Scrap Metal Dealers Act 2013 creates a new criminal offence which prohibits scrap metal dealers from paying for scrap metal in cash, only permitting electronic payment or payment by cheque.  The Act also increases the fines available for key offences under the Scrap Metal Dealers Act 1964 so that the most serious offences can result in fines of £5000 and also revises the powers of the Police so that Police Officers can enter by warrant, any place to which admission is reasonably required to ascertain whether the prohibition on cash payments is being complied with.

The offence of buying scrap metal for cash now applies to ALL scrap metal dealers, and the previous exemption for itinerant collectors no longer applies.

Customer Complaints
